You appear to have been misinformed somewhat. The presence of freedays does NOT prevent you from activating cell wars. Even if they're inside cells, they've likely switched classes meaning that they no longer have their freeday protection and thus aren't freedays. Even if there is an intact freeday inside cells, the other reds can't actually kill him as long as he doesn't attack another red.
That being said, you DO have to give a reasonable warning before activating FF, so he has still been punished.
